Terms of Business

The Terms of Business set out the basis on which Lyons Financial Services will provide business services to you as an individual/group private client. Please take a few minutes to read these and if you have any questions, I will be happy to answer them.

Roisin Lyons, director of Lyons Financial Services has 15 years experience within the life assurance business serving both corporate and individual clients. Roisin graduated as a Qualified Financial Advisor in May 1999, the approved qualification recognised by the LIA, The Insurance Institute of Ireland and the Institute of Bankers in Ireland. As a QFA and a member of the LIA, continuous accrual of study hours is required which enables the holder keep pace with the latest taxation and legislative developments. Roisin acts as an impartial advisor giving the best advice appropriate to the needs and circumstances of the client.

Lyons Financial Services is regulated by the Irish Financial Services Regulatory Authority as a Multi-Agency Intermediary. A copy of the Firms Statement of Authorised status from IFSRA appears on this Sheet for your perusal..

Lyons Financial Services currently holds a mortgage intermediary agency with Ulster Bank, and partners with EZFinance Ltd for all other mortgage lending institutions.

Lyons Financial Services provides you with the following:-
Financial check-up to assess your needs and wants, research of the appropriate product providers together with advice and recommendations in relation to the most suitable products to satisfy your requirements.
Receiving and transmitting orders on your behalf for a product (s).

Lyons Financial Services' reward for services usually takes the form of commission allowed to Lyons Financial Services as intermediary from the product producer to whom orders are transmitted. Summary details of these payments will be included in a production information document which you are legally entitled to receive before an application for a product is completed and full details will be included with what is called a 'cooling-off' letter, ie., a 30 day period within which you can change your mind before proceeding. Often such commission is paid to Lyons Financial Services over a period. The client agrees that, as this commission is in respect of services already performed, in the event that the client transfers his/her business elsewhere, Lyons Financial Services shall continue to receive the commission for a period of the balance of the relevant period.

Fees, if charged would be quoted and agreed before the client incurs any obligation to pay.

Lyons Financial Services may at times receive referrals from or act as agents for its professional connections (eg. Solicitors, Accountants) and Lyons Financial Services reserves the right to share commission and/or fees with such connections at its discretion.

Lyons Financial Services is unable to look after a client if the necessary Money Laundering verification checks as required under the Criminal Justice Act 1994 have not been undertaken. If such checks are delayed, either by a failure of the client to supply documentation or any other reason, Lyons Financial Services shall not be responsible for any loss incurred due to the delay in investing the client monies.

In relation to life assurance and permanent health insurance proposals, cover does not come into force until insurers issues, and the client confirms acceptance of, terms of acceptance following the provision of medical evidence in respect of the life to be assured if this is a condition of the policy or the scheme. Where the client fails in the above, or fails to ensure that the insurer obtains the required medical evidence delays may ensue in the acceptance of the client's proposal and the insurance arrangement coming into force (even where premiums have been paid).

Once investment arrangements or any other transactions have been made following client's instructions, no further advice will be given automatically. However, Lyons Financial Services will advise the client and provide investment reviews or further advices at any time upon request.

It is the policy of Lyons Financial Services to avoid any conflict of interest when providing business services to its clients. However, where an unavoidable conflict may arise, we will advise you of this in writing before proceeding to provide any business service. If you have not been advised of any such conflict, you are entitled to assume that none has arisen.

Product providers may withdraw benefit or cover on default of any payments due under any products arranged for your benefit. Details of these provisions will be included in your product terms and conditions.

Any complaint which you may have in relation to the business services provided should be made in writing to Lyons Financial Services. Any such complaint will be acknowledged and dealt with according to the complaints procedure of Lyons Financial Services. In the event that you remain dissatisfied with our handling and response to your complaint, you are entitled to refer your complaint to the Irish Financial Services Regulatory Authority.

Lyons Financial Services is a member of the Investor Compensation Scheme which provides certain remedies to eligible clients on default by us, to a maximum of €20,000 or 90% of the loss whichever is the lesser.

Lyons Financial Services is a member of the Professional Insurance Brokers Association and the Life Insurance Association.

Lyons Financial Services will only advise on the products of the above list of Life companies.

Lyons Financial Services at all times remains directly responsible to clients for the conduct of their affairs in accordance with this statement.
